Upon request of the Planning & Zoning Subcommittee, that the City Council votes to advertise the proposed amendments to the SPGA for public hearing; and further vote to refer the proposed amendments to the Planning Board for public hearing as required by MGL ch 40a Sec 5. Amendments are as follows: To amend the Framingham Zoning Ordinances Chapter 435 Section 46 Special Permits and Special Permit Granting Authority, and Section 435 Attachment I - Table of Uses, to add the City Council as the Special Permit Granting Authority for multi-family, mixed-use and mixed-use complex and assisted living facilities for buildings with a gross floor area over 75,000 sq.ft.; further amending Section 435 Attachment I Table of Uses by amending footnotes 9 & 10 to read "Mixed-use structures and mixed-use complexes over 30,000 square feet but not greater than 75,000 square feet shall require a Special Permit from the Planning Board. Multifamily structures with over 30,000 square feet but not greater than 75,000 square feet shall require a special permit from the Planning Board. All multi-family, mixed-used, mixed-use complex buildings including assisted living facilities with a gross floor area of greater than 75,000 square feet shall require a Special Permit from the City Council.
